(Senate Bill 197)
AN ACT concerning
Circuit Courts - Rental of Space for Clerks of Court
FOR the purpose of requiring each State budget to include a certain appropriation to
the Department of General Services to pay rent to counties, including Baltimore
City, for certain space occupied by clerks of the circuit courts; establishing
providing that the amount of the rent shall be limited to certain rates in certain
years; establishing the rental rate in certain fiscal years; prohibiting
reimbursement of certain costs; prohibiting a county from decreasing the square
footage allocated to the clerk of the circuit court below a certain amount, unless
the county and the Administrative Office of the Courts agree otherwise;
requiring counties to use the savings resulting from this Act for the circuit
courts or related public safety purposes; requiring certain reports on certain
expenditures; providing for the construction of this Act; limiting general fund
expenditures to a certain amount for a certain purpose in certain fiscal years;
providing for a delayed effective date; and generally relating to rental of space
for clerks of the circuit courts.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Courts and Judicial Proceedings
1-504.
(A) THERE SHALL BE INCLUDED IN EACH STATE BUDGET AN APPROPRIATION
TO THE DEPARTMENT OF GENERAL SERVICES IN THE TOTAL AMOUNT NECESSARY
TO PAY RENT DIRECTLY TO COUNTIES FOR SPACE OCCUPIED IN COUNTY FACILITIES
BY CLERKS OF THE CIRCUIT COURTS, AS PROVIDED IN THIS SECTION.
(B) TO THE EXTENT PROVIDED IN THE STATE BUDGET THE RENT SHALL BE
$10 CALCULATED PER NET USABLE SQUARE FOOT, WITH NO ADDITIONAL
REIMBURSEMENT OF MAINTENANCE AND UTILITY COSTS COST:
(1) FOR FISCAL YEAR 2004, AT A RATE NOT TO EXCEED $2.50;
(2) FOR FISCAL YEAR 2005, AT A RATE NOT TO EXCEED $5.00; AND
(3) FOR FISCAL YEAR 2006 AND EACH FISCAL YEAR THEREAFTER AT A
RATE OF $10.
