PARRIS N. GLENDENING, Governor Ch. 336
Department of Health and Mental Hygiene; requiring that all disclosures made
to a certain office be in writing; requiring that certain disclosures made to
certain persons be in writing, if requested
requiring a certain description be
made in writing at a certain time; requiring disclosure of the written description
to certain persons; requiring the Unit or Program making certain disclosures to
include certain information; requiring the Office of Health Care Quality to
examine and verify the accuracy of certain records as part of certain facility's
license renewal procedure; requiring the Office of Health Care Quality to take
certain actions if the Office makes certain findings
authorizing the Department
of Health and Mental Hygiene to adopt regulations as necessary; defining a
certain term; and generally relating to the disclosure of services by Alzheimer's
Special Care Units or Programs. BY adding to Article - Health - General Section 20-109 Annotated Code of Maryland (2000 Replacement Volume and 2001 Supplement) SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows: Article - Health - General 20-109. (A) (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.
(2) , "ALZHEIMER'S SPECIAL CARE UNIT OR PROGRAM" MEANS A
SECURED OR SEGREGATED SPECIAL UNIT OR PROGRAM SPECIFICALLY DESIGNED
FOR INDIVIDUALS WITH A PROBABLE OR CONFIRMED DIAGNOSIS OF ALZHEIMER'S
DISEASE OR A RELATED DISORDER (3) "FACILITY" MEANS ANY NURSING HOME FACILITY, RESIDENTIAL
CARE FACILITY, ASSISTED LIVING FACILITY, OR ADULT DAY CARE CENTER THAT
PROVIDE
S OR THAT ADVERTISES, MARKETS, OR OTHERWISE PROMOTES THE
FACILITY AS PROVIDING AN ALZHEIMER'S SPECIAL CARE UNIT OR PROGRAM.
(B) ANY FACILITY WHICH AN ASSISTED LIVING PROGRAM THAT PROVIDES
CARE FOR OR OFFERS TO PROVIDE CARE FOR PERSONS WITH ALZHEIMER'S DISEASE
OR A RELATED DISORDER BY MEANS OF AN ALZHEIMER'S SPECIAL CARE UNIT OR
PROGRAM, SHALL DISCLOSE HOW THE FORM OF CARE AND TREATMENT PROVIDED
BY THE ALZHEIMER'S SPECIAL CARE UNIT OR PROGRAM IS SPECIFICALLY DESIGNED
FOR THE SPECIALIZED CARE OF INDIVIDUALS DIAGNOSED WITH ALZHEIMER'S
DISEASE OR A RELATED DISORDER (C) (1) THE DISCLOSURE SHALL BE MADE TO THE OFFICE OF HEALTH CARE
QUALITY IN THE DEPARTMENT AND TO ANY PERSON REQUESTING THE
INFORMATION ABOUT THE UNIT OR PROGRAM.
