(8) A REPRESENTATIVE OF THE FEDERAL RAILROAD ADMINISTRATION
OR THE NATIONAL TRANSPORTATION SAFETY BOARD WHILE PERFORMING OFFICIAL
DUTIES.

(A) (C) (1) WITHOUT THE CONSENT OF THE RAILROAD CARRIER OR OTHER
LAWFUL AUTHORIZATION, A PERSON MAY NOT RIDE ON THE OUTSIDE OF A TRAIN,
OR ON THE INSIDE OF A PASSENGER CAR, LOCOMOTIVE, OR FREIGHT CAR,
INCLUDING A BOXCAR, FLATBED, OR INSIDE OF A RAILROAD VEHICLE, INCLUDING A
FLATBED OR CONTAINER.
(B) (2) A PERSON WHO VIOLATES THIS SECTION SUBSECTION IS GUILTY OF
A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO IMPRISONMENT NOT
EXCEEDING 6 MONTHS OR A FINE NOT EXCEEDING $1,000 OR BOTH.

(A) (D) (1) WITHOUT THE CONSENT OF THE RAILROAD CARRIER OR OTHER
LAWFUL AUTHORIZATION, AND EXCEPT TO CROSS THE PROPERTY AT A PUBLIC
HIGHWAY OR OTHER AUTHORIZED CROSSING, A PERSON MAY NOT KNOWINGLY
ENTER OR REMAIN ON RAILROAD PROPERTY.
(B) (2) A PERSON WHO VIOLATES THIS SECTION SUBSECTION IS GUILTY OF
A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO IMPRISONMENT NOT
EXCEEDING 30 DAYS OR A FINE NOT EXCEEDING $100 OR BOTH.

THIS PART MAY BE CITED AS THE "RAILROAD TRESPASS PREVENTION ACT".
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 2002.
