Ch. 307 2002 LAWS OF MARYLAND
(C) THE ADMINISTRATION MAY IMPOSE A PENALTY NOT EXCEEDING $500 PER
DAY PER VIOLATION FOR EACH DAY A VIOLATION OCCURS ON A LICENSEE THAT
FAILS TO COMPLY WITH THE REPORTING REQUIREMENTS ESTABLISHED UNDER §
7-306. (K) (L) OF THIS TITLE. [(c)] (D) Except as otherwise provided in § 10-226 of the State Government
Article, before the Administration takes any action under this section, the
Administration shall give the applicant or licensee notice and an opportunity for a
hearing. SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
July 1, 2002. Approved May 6, 2002.
CHAPTER 307
(Senate Bill 251) AN ACT concerning Business Regulation - Lodging Establishments - Rights and Responsibilities of Innkeepers FOR the purpose of authorizing an innkeeper to refuse lodging or services to or
remove from a lodging establishment an individual who is unwilling or unable
to pay for lodging or services, is under the influence of alcohol or drugs, is
disorderly, destroys or damages property of the lodging establishment or its
guests, is reasonably suspected of using the lodging establishment for the
possession or use of a controlled dangerous substance, is reasonably suspected of
using the lodging establishment for the consumption of alcohol by an individual
under the legal age, is reasonably suspected of possessing certain dangerous
items, or refuses to abide by certain rules of the lodging establishment;
requiring the innkeeper to provide a certain notice and refund certain payments
when removing an individual from a lodging establishment; establishing the
actions an innkeeper may take when removing an individual from a lodging
establishment; authorizing an innkeeper to require that a prospective guest
register, provide certain identification, and demonstrate an ability to pay for
lodging; authorizing an innkeeper to limit the number of individuals who may
occupy a room at a lodging establishment; authorizing an innkeeper to require
the parent or guardian of a guest who is a minor to accept liability for the
minor's lodging costs and any damages the minor causes and make an advance
deposit up to a certain amount; authorizing an innkeeper to require certain
individuals to make an advance deposit up to a certain amount; requiring an
innkeeper to post certain information; providing an innkeeper with immunity
from criminal and civil prosecution under certain circumstances;
specifying that
this Act does not alter a certain prohibition against discrimination; defining
certain terms; and generally relating to the rights and responsibilities of
innkeepers and lodging establishments.
