[(vi)] (VII) Two members shall be elected from that part of
legislative district 42 that is located in Baltimore County;
(VIII) TWO MEMBERS SHALL BE ELECTED FROM THAT PART OF
LEGISLATIVE DISTRICT 43 THAT IS LOCATED IN BALTIMORE COUNTY;
(IX) TWO MEMBERS SHALL BE ELECTED FROM THAT PART OF
LEGISLATIVE DISTRICT 44 THAT IS LOCATED IN BALTIMORE COUNTY; AND
[(vii)] (X) [One member] TWO MEMBERS shall be elected from that
part of legislative district 46 that is located in Baltimore County[; and
(viii) Two members shall be elected from that part of legislative
district 47 that is located in Baltimore County].
(4) Only individuals affiliated with the Democratic Party and who are
registered to vote in Baltimore County may vote for the election of members to the
Baltimore County Democratic Party Central Committee under this section.
(5) The number of Democratic Party Central Committee members to be
elected from each legislative district, or portion of legislative district, in Baltimore
County shall be determined upon completion of each legislative districting.
SECTION 3. AND BE IT FURTHER ENACTED, That Section 1 of this Act shall
take effect October 1, 2002. It shall remain effective until the taking effect of Section
2 of this Act. If Section 2 of this Act takes effect, Section 1 of this Act shall be
abrogated and of no further force and effect.
SECTION 1. AND BE IT FURTHER ENACTED, That, subject to the provisions
of Section 3 of this Act, this Act shall take effect January 1, 2003.
SECTION 3. AND BE IT FURTHER ENACTED, That:
(a) The provisions of Section 1 and Section 2 of this Act are contingent on the
Legislative Districting Plan of 2002 that took effect on February 22, 2002 remaining
unchanged with respect to the legislative districts lying in whole or in part in
Baltimore County as a result of an order issued by a court in any lawsuit filed
challenging the constitutionality or legality of the Legislative Districting Plan of
2002.
(b) If a ruling by a court in a lawsuit described in subsection (a) of this Section
results in changes to the Legislative Districting Plan of 2002 with respect to the
legislative districts lying in whole or in part in Baltimore County, then Sections 1 and
2 of this Act are null and void without the necessity of further action by the General
Assembly.
SECTION 4. AND BE IT FURTHER ENACTED, That if, by June 30, 2002, a
court has issued an order that alters the Legislative Districting Plan of 2002 with
respect to legislative districts lying in whole or in part in Baltimore County, then the
Baltimore County Democratic Party Central Committee shall consist of five members
elected from each councilmanic district in Baltimore County.
