2002 LAWS OF MARYLAND
4. MEDICAL HISTORY; 5. DISABILITY CHARACTERISTICS; AND 6. PSYCHOSOCIAL HISTORY TO THE EXTENT KNOWN. (E) IF PHYSICAL RESTRAINT IS INCLUDED ON A STUDENT'S INDIVIDUALIZED
EDUCATION PLAN AND IS USED MORE THAN FOUR TIMES IN ONE MONTH, THE
INDIVIDUALIZED EDUCATION PLAN TEAM SHALL:
(1) MEET TO RECOMMEND A NEW FUNCTIONAL BEHAVIOR ASSESSMENT
AND MAKE REVISIONS TO THE STUDENT'S BEHAVIOR INTERVENTION PLAN;
AND (2) REVIEW THE STUDENT'S INDIVIDUAL EDUCATION PLAN AND
PLACEMENT.
(F) (1) WHENEVER PHYSICAL RESTRAINT IS USED, SCHOOL PERSONNEL
SHALL FULLY DOCUMENT THE INCIDENT, INCLUDING:
(I) THE EVENTS LEADING UP TO THE INCIDENT; (II) THE TYPE OF PHYSICAL RESTRAINT USED; (III) THE STARTING AND STOPPING TIME OF THE PHYSICAL
RESTRAINT; AND
(IV) THE STAFF INVOLVED. (2) (I) THE PARENTS OR GUARDIAN OF THE STUDENT SHALL BE
NOTIFIED WHENEVER PHYSICAL RESTRAINT IS USED.
(II) THE NOTICE REQUIRED UNDER SUBPARAGRAPH (I) OF THIS
PARAGRAPH SHALL:
1. INCLUDE THE ATTEMPTED TELEPHONE CONTACT ON THE
DAY OF THE PHYSICAL RESTRAINT; AND
2. BE PROVIDED WITHIN 3 BUSINESS DAYS OF THE DATE
THE STUDENT IS SUBJECT TO PHYSICAL RE
STRAINT. (G) A STUDENT WHO NO LONGER POSES AN IMMEDIATE PHYSICAL RISK TO
THE STUDENT OR TO ANOTHER PERSON
SHALL BE RELEASED FROM PHYSICAL
RE
STRAINT. (H) A PERSON MAY NOT USE PHYSICAL RESTRAINT AS A MEANS OF
DISCIPLINE.
