University, regardless of the source of funds, to the extent that the Board grants
authority over specific projects or classes of projects; and
(iv) leases of real property for the University if the lease payments
are not paid from the General Fund of the State.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 2002.

(House Bill 96)
AN ACT concerning
State Procurement Contracts for Construction - Retainage - Maryland
Transportation Authority
FOR the purpose of authorizing the Maryland Transportation Authority to withhold
payments from a contractor in addition to retainage for certain contracts under
certain circumstances; authorizing the Authority to deposit retainage in a
certain account; restricting the amount that a contractor may withhold from a
subcontractor under certain circumstances; and generally relating to retainage
in State procurement contracts for construction.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - State Finance and Procurement
13-225.
(a) (1) In this section the following words have the meanings indicated.
(2) "Payment security" has the meaning stated in § 17-101 of this
article.
(3) "Performance security" has the meaning stated in § 17-101 of this
article.
