PARRIS N. GLENDENING, Governor
Ch. 26
DESCRIBED IN SUBSECTION (B) OF THIS SECTION IN RELATION TO THE CARE,
CUSTODY, OR PROTECTION OF THE MINOR CHILD BY THE AGENT, OFFICER, OR
REPRESENTATIVE. (2) A PERSON WHO VIOLATES THIS SUBSECTION IS GUILTY OF A
MISDEMEANOR REVISOR'S NOTE: Chapter 26, Acts of 2002, which enacted the Criminal Law
Article, also added this section, which is derived without substantive
change from former Art. 27, § 399 and FL § 5-503. In subsections (b) and (c) of this section, the references to "care" of a minor
child are substituted for the former references to "personal charge" of a
minor child for clarity and consistency within this section. Similarly, in
subsection (c) of this section, the former reference to "possession" of a
minor child is deleted in light of the reference to "custody" of the minor
child. In subsection (b) of this section, the reference to a Maryland corporation
"formed" for the care, custody, or protection of minor children is added for
clarity. Also in subsection (b) of this section, the reference to a "Maryland
corporation" is substituted for the former reference to "any institution,
society, or body, incorporated under the laws of this State" for clarity and
consistency with CA § 1-101, which defines "Maryland corporation" to
mean a corporation organized and existing under the laws of the State. Also in subsection (b) of this section, the references to "minor children" and
"minor child", respectively, are substituted for the former references to
"children or minors" and "any person under eighteen years of age" in light
of Art. 1, § 24 and for consistency within this subtitle. Also in subsection (b) of this section, the reference to an agent "ha[ving]"
the authority of a law enforcement officer is substituted for the former
reference to an agent "be[ing] entitled to" the authority of a law
enforcement officer for clarity. Also in subsection (b) of this section, the reference to a "law enforcement
officer" is substituted for the former, obsolete reference to a "conservator of
the peace" for clarity. Also in subsection (b) of this section, the former reference to an agent who
has "possession" of a minor child is deleted as implicit in the reference to
the agent having "custody" of the minor child. Subsection (c) of this section is revised in standard language used to state
a prohibition.
In subsection (c) of this section, the reference to a minor "child" is added for
consistency within this section and within this subtitle.
