2002 LAWS OF MARYLAND
GRAVEYARD THAT PRODUCES, COLLECTS, RETAINS, DUMPS, OR DEPOSITS TRASH,
JUNK, OR OTHER REFUSE HAS NOT ERECTED RETAINING WALLS OR OTHER
RESTRAINING DEVICES OR PROCEDURES APPROVED BY THE ADMINISTRATION, THE
PRESENCE OF TRASH, JUNK, AUTOMOBILES, OR AUTOMOBILE PARTS IN WATERS OF
THE STATE, OR ON EMBANKMENTS OR OTHER SITES WHERE IT MAY READILY FALL
INTO OR BE TRANSPORTED INTO THE WATERS OF THE STATE, IS PRIMA FACIE
EVIDENCE OF A VIOLATION OF § 5-10A-02 OF THIS SUBTITLE. REVISOR'S NOTE: Chapter 26, Acts of 2002, which enacted the Criminal Law
Article, also added this section, which is new language derived without
substantive change from former Art. 27, § 469(b). The former reference to "throw[ing trash]" is deleted as implicit in
"dumping] or deposit[ing trash]". The former redundant reference to "automobile tires ... and other refuse" is
deleted as included in the reference to "trash" and "automobile parts". The former phrase "and be subject to the penalties imposed herein" is
deleted in light of § 5-10A-02 of this subtitle. Defined terms: "Administration" § 5-101

"Junkyard" § 5-10A-01 "Scrap metal processing facility" § 5-10A-01

THIS SUBTITLE OR THE DEPARTMENT OF JUVENILE JUSTICE UNDER ARTICLE 83C OF
THE CODE. (B) AUTHORITY OF AGENTS, OFFICERS, AND REPRESENTATIVES. AN AGENT, OFFICER, OR REPRESENTATIVE OF A MARYLAND CORPORATION
FORMED FOR THE CARE, CUSTODY, OR PROTECTION OF MINOR CHILDREN WHO HAS
CARE OR CUSTODY OF A MINOR CHILD HAS THE AUTHORITY AND PRIVILEGES OF A
LAW ENFORCEMENT OFFICER FOR ANY PURPOSE RELATED TO THE OBJECTIVES OF
THE CORPORATION. (C) INTERFERING WITH OR OBSTRUCTING AGENTS, OFFICERS, AND
REPRESENTATIVES. (1) A PERSON, INCLUDING A PERSON ACTING UNDER CLAIM OR COLOR
OF AUTHORITY OVER A MINOR CHILD AS A PARENT, GUARDIAN, OR OTHERWISE, MAY
NOT INTERFERE WITH OR OBSTRUCT AN AGENT, OFFICER, OR REPRESENTATIVE
