to clarify who makes appointments to the Department and to restate this
provision in the active voice.

Also in subsection (a)(2) of this section, the reference to eligible
"candidates" is substituted for the former reference to eligible "persons" to
conform to language used in the State Personnel and Pensions Article. See,
e.g.,
SP § 7-203.

In subsection (b)(1) of this section, the former reference to a "bona fide"
resident of the State is deleted as surplusage.

In subsection (b)(2) of this section, the former specific reference to "§ 15" of
former Article 88B is deleted as unnecessary in light of the general
reference to "this title". Former Art. 88B, § 15, as it related to establishing
qualifications for employees of the Department, is revised in § 2-204(b) of
this title.

2-403. PROBATION AFTER APPOINTMENT.

(A)     POLICE EMPLOYEES.

EACH POLICE EMPLOYEE, INCLUDING AN INDIVIDUAL WHO IS APPOINTED TO
THE DEPARTMENT FOR TRAINING BEFORE REGULAR ASSIGNMENT AS A POLICE
EMPLOYEE, SHALL REMAIN IN PROBATIONARY STATUS FOR A PERIOD OF 2 YEARS
AFTER THE DATE OF APPOINTMENT TO THE DEPARTMENT.

(B)     CIVILIAN EMPLOYEES.

EACH CIVILIAN EMPLOYEE SHALL REMAIN IN PROBATIONARY STATUS FOR THE
PERIOD REQUIRED UNDER TITLE 7, SUBTITLE 4 OF THE STATE PERSONNEL AND
PENSIONS ARTICLE.

REVISOR'S NOTE: This section is new language derived without substantive
change from the first and second sentences of former Art. 88B, § 18.

2-404. PROMOTIONS.

(A)     "OBSOLETE RANK" DEFINED.

IN THIS SECTION, "OBSOLETE RANK" MEANS A RANK DESIGNATED BY THE
SECRETARY TO WHICH NO FURTHER PROMOTIONS WILL BE MADE.

(B)     SECRETARY TO MAKE PROMOTIONS.

THE SECRETARY SHALL MAKE ALL PROMOTIONS.

(C)     POLICE EMPLOYEES — IN GENERAL.
