REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 88B, § 24.

In subsections (a) and (c) of this section, the general references to "this
article" are retained. The references in the revision to "this article" are
broader than the former references to "this article", which meant former
Article 88B, because this revised article includes provisions from other
articles in addition to Article 88B. No substantive change is intended.

In subsection (b) of this section, the reference to being expressly provided
"in this article" is substituted for the former reference to being expressly
provided "herein" for specificity and to conform to subsections (a) and (c) of
this section.

2-402. APPOINTMENT OF EMPLOYEES.

(A)     IN GENERAL.

(1)      IN ACCORDANCE WITH THE STATE BUDGET, THE SECRETARY SHALL
APPOINT THE EMPLOYEES THAT THE SECRETARY CONSIDERS NECESSARY FOR THE
EFFICIENT ADMINISTRATION OF THE DEPARTMENT.

(2)      THE SECRETARY SHALL MAKE EACH APPOINTMENT FROM A LIST OF
ELIGIBLE CANDIDATES IN ACCORDANCE WITH THE STATE PERSONNEL AND
PENSIONS ARTICLE.

(B)     QUALIFICATIONS FOR APPOINTMENT.
EACH APPOINTEE TO THE DEPARTMENT SHALL:

(1)      BE A RESIDENT OF THE STATE ON THE DATE OF APPOINTMENT; AND

(2)      HAVE THE CHARACTER, EDUCATION, AND OTHER QUALIFICATIONS
ESTABLISHED BY THE SECRETARY UNDER THIS TITLE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 88B, § 17(a) and the first sentence of (b).

In subsection (a)(1) of this section, the phrase "[i]n accordance with the
State budget" is substituted for the former phrase "within the limits of any
appropriation made for such purpose" to conform to language used in this
and other revised articles of the Code. See, e.g., CS § 2-106(a), BR
§ 2-103(b)(1), and LE § 2-104(g).

In subsection (a)(2) of this section, the reference to the "Secretary" is added
