Dear Mr. President:

In accordance with Article II, Section 17 of the Maryland Constitution, today I have
vetoed Senate Bill 385 - Montgomery County - Deputy Clerk or Sheriff - Oath of
Office.

This bill requires that every deputy clerk or sheriff in Montgomery County take and
sign the oath or affirmation prescribed by Article I, Section 9 of the Maryland
Constitution.

House Bill 401, which was passed by the General Assembly and signed by me,
accomplishes the same purpose. Therefore, it is not necessary for me to sign Senate
Bill 385.

AN ACT concerning

Montgomery County - Deputy Clerk or Sheriff - Oath of Office

FOR the purpose of requiring that every deputy clerk or sheriff in Montgomery
County take and sign the oath or affirmation prescribed by the Maryland
Constitution; and generally relating to oaths of office.

BY repealing and reenacting, with amendments,
Article - Courts and Judicial Proceedings
Section 2-104

Annotated Code of Maryland
(2002 Replacement Volume)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Courts and Judicial Proceedings

2-104.

(a)     Every auditor, clerk, sheriff, constable, commissioner, surveyor, or other
officer before he assumes the duties of his office, shall take and sign the oath or
affirmation prescribed by the Constitution.

(b)     [Every] EXCEPT AS PROVIDED IN SUBSECTION (D) OF THIS SECTION,
EVERY deputy clerk or sheriff shall take and subscribe the following oath or
affirmation: "I, A.B., do swear (or affirm) that I will not for lucre or malice delay any
person applying to me for any business belonging to the office I officiate in, and that
