Dear Mr. President:

In accordance with Article II, Section 17 of the Maryland Constitution, today I have
vetoed Senate Bill 28 - Prince George's County - Criminal Procedure - Probation
Before Judgment.

This bill includes Prince George's County as a county in which the court is authorized
to impose a sentence of imprisonment as a condition of probation before judgment.

Senate Bill 428, which was passed by the General Assembly and signed by me,
accomplishes the same purpose. Senate Bill 428 is a broader bill and extends
statewide the authority of a court to impose a sentence of imprisonment as a condition
of a suspended sentence, probation before judgment, and probation after judgment.
Therefore, it is not necessary for me to sign Senate Bill 28.

AN ACT concerning

Prince George's County - Criminal Procedure - Probation Before Judgment

FOR the purpose of including Prince George's County among those counties in which
the court is authorized to impose a sentence of imprisonment as a condition of
probation before judgment; and generally relating to conditions of probation
before judgment.

BY repealing and reenacting, with amendments,
Article - Criminal Procedure
Section 6-220(h)
Annotated Code of Maryland
(2001 Volume and 2002 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Criminal Procedure

6-220.

(h) In Allegany County, Calvert County, Charles County, Garrett County,
Howard County, PRINCE GEORGE'S COUNTY, and St. Mary's County, the court may
impose a sentence of imprisonment as a condition of probation.
