2003 LAWS OF MARYLAND

(1)      BE A FULL-TIME POLICE OFFICER EMPLOYED BY A RAILROAD
COMPANY ON JULY 1, 1979; OR

(2)      MEET ALL THE EDUCATIONAL AND TRAINING REQUIREMENTS
REQUIRED BY THE POLICE TRAINING COMMISSION.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 23, § 256(c).

It is revised as substantive provisions rather than a definition of "qualified
person" because the former definition listed the qualifications necessary
for appointment to act as a railroad police officer.

In subsection (d)(1) of this section, the former reference to the "Maryland"
Police Training Commission is deleted to use the proper title of the
Commission.

As to the Police Training Commission, see Subtitle 2 of this title.

3-404. APPLICATIONS FOR APPOINTMENTS.

(A)     IN GENERAL.

THE CHIEF RAILROAD POLICE OFFICER OF A RAILROAD COMPANY SHALL:

(1)   SUBMIT TO THE SECRETARY UNDER OATH AN APPLICATION FOR
APPOINTMENT OF EACH RAILROAD POLICE OFFICER ON THE FORM THAT THE
SECRETARY REQUIRES; AND

(2)   PAY TO THE SECRETARY THE APPLICATION FEE SET BY THE
SECRETARY.

(B)  APPLICATION FEE NONREFUNDABLE.

THE APPLICATION FEE IS NONREFUNDABLE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 23, § 257(b).

In the introductory language of subsection (a) of this section, the former
reference to the "requesting" railroad is deleted as implicit.

In subsection (a)(1) of this section, the former reference to making an
application "in writing" is deleted as unnecessary in light of the
requirement to submit the application on the form that the Secretary
requires.
