(3) (i) There is a Department of Juvenile Justice Summer Opportunity
Pilot Program Fund to finance the Program.

(ii) The Fund is a continuing, nonlapsing special fund, and is not
subject to § 7-302 of the State Finance and Procurement Article.

(iii) The Fund [may consist of moneys the Governor includes]
CONSISTS OF:

1.       MONEY APPROPRIATED in the State budget [for] TO the
Fund; AND

2.       MONEY FROM ANY OTHER SOURCE ACCEPTED FOR THE
BENEFIT OF THE FUND.

(iv) The State Treasurer shall hold and the State Comptroller shall
account for the Fund.

(v) The Fund shall be invested and reinvested and any investment
earnings shall be paid into the Fund.

(c) (1) The Program shall be administered as provided in this subsection.

(2)     (i) A group home operator or other interested party in a county:

1.       May develop a proposal for educational curriculum and
activities during the summer months using faculty of the county school system for
children in that county who are under the supervision of the Department; and

2.       Shall submit the proposal to the county board of education
for review.

(ii) The county board:

1.       Shall review the proposal;

2.       In consultation with the requesting party, may make any
changes that it deems necessary; and

3.       From among the proposals submitted, may forward a final
proposal to the Department for approval by January 15 of each year.

(3)     The Department:

(i) In consultation with the State Board of Education, shall review
a final proposal submitted by a county board by March 15 of each year;

(ii) May make recommendations that it considers necessary; and

(iii) May approve a final proposal of a county board for
implementation in that county.
