PARRIS N. GLENDENING, Governor S.B. 798
(2) IN BALTIMORE CITY, A LICENSED PREMISES SHALL CEASE ALL
OPERATIONS, INCLUDING THE SERVING OF ALCOHOLIC BEVERAGES OR FOOD AND
PROVIDING ENTERTAINMENT, AT THE CLOSING HOUR FOR THAT CLASS OF LICENSED
PREMISES SPECIFIED IN THIS ARTICLE. (3) NOTWITHSTANDING PARAGRAPH (2) OF THIS SUBSECTION, THE
BOARD OF LIQUOR LICENSE COMMISSIONERS MAY GRANT AN EXEMPTION FOR
REMAINING OPEN AFTER HOURS TO: (I) A HOLDER OF A CLASS B RESTAURANT LICENSE, ONLY FOR
SERVING FOOD TO PATRONS SEATED PATRONS FOR DINING; OR (II) A PHARMACY THAT FILLS PRESCRIPTIONS. (4) A PHARMACY THAT RECEIVES AN EXEMPTION UNDER PARAGRAPH (3)
OF THIS SUBSECTION MAY ALSO SELL PRODUCTS OTHER THAN ALCOHOL AFTER
NORMAL CLOSING HOURS. (5) NOTWITHSTANDING THE HOUR RESTRICTIONS UNDER PARAGRAPH
(2) OF THIS SUBSECTION, A HOTEL THAT HOLDS A CLASS B LICENSE AND THAT
SERVES FOOD TO SEATED CUSTOMERS OR TO PRIVATE FUNCTIONS OR GUEST
ROOMS MAY CONTINUE TO PROVIDE FOOD SERVICE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act is an emergency
measure, is necessary for the immediate preservation of the public health and safety,
has been passed by a yea and nay vote supported by three-fifths of all the members
elected to each of the two Houses of the General Assembly, and shall take effect from
the date it is enacted.

Annapolis MD 21401 Dear Mr. President: In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed Senate Bill 798 - Private Review Agents - Market Conduct Examinations. This bill requires the Insurance Commissioner to conduct a market conduct
examination of an HMO in the same manner as the Commissioner currently conducts
examinations of health insurers. The Insurance Commissioner must examine each
HMO every five years. House Bill 1222, which was passed by the General Assembly and signed by me on
May 11, 2000, accomplishes the same purpose. Therefore, it is not necessary for me to
sign Senate Bill 798. Sincerely,
