[(ii)](2) Standards for classes of development eligible for
administrative adjustments; and
[(iii)] (3) [Maximum] THE MAXIMUM variation from a zoning
requirement allowable under an administrative adjustment.
[(6)] (E) Procedures for administrative adjustments may include;
[(i)] (1) Applications;
[(ii)] (2) Notice to the public and parties in interest;
[(iii)] (3) Opportunity for public hearing;
[(iv)] (4) Taking of testimony and evidence; and
[(v)] (5) Decision making.
[(7)] (F) A decision on an application for an administrative adjustment
shall include written findings of fact.
[(8)] (G) [The] BY ORDINANCE OR OTHER ADOPTED PROCEDURE, THE
local legislative body may [provide, by ordinance or other adopted procedure, for the]
ALLOW AN appeal TO THE BOARD OF APPEALS of a decision to approve or deny an
administrative adjustment [to the board of appeals].

from former § 4.05(d) of this article.
14.09. WORCESTER COUNTY.
(A) THIS SECTION APPLIES TO WORCESTER COUNTY.
(b) (1) [In Worcester County, notwithstanding] NOTWITHSTANDING any
other [provisions of the] PROVISION OF law, ON THE ZONING OR REZONING OF ANY
LAND, the County Commissioners[, upon the zoning or rezoning of any land or
lands,] may impose [such] restrictions, [conditions] CONDITIONS, or limitations [as
may be deemed by them] CONSIDERED BY THE COUNTY COMMISSIONERS to be
appropriate to preserve, [improve] IMPROVE, or protect the general character and
design [of the lands] OF:
(I) THE LAND and improvements being zoned or [rezoned, or of
the] REZONED; OR
(II) THE surrounding or adjacent lands and improvements[, and].
(2) ON THE ZONING OR REZONING OF ANY LAND, THE COMMISSIONERS
may[, upon the zoning or rezoning of any land or lands,] retain or reserve the power
[and authority] to approve or disapprove the design of buildings, construction,
[landscaping] LANDSCAPING, or other improvements, alterations, and changes made
[or to be made] on the [subject] land [or lands] to assure conformity with the intent
and [purpose] PURPOSES of this article and of the county zoning ordinance.
