all units of the Executive Branch of State government including public institutions of
higher education other than the University System of Maryland. 3-403. (a) The Secretary is responsible for developing, maintaining, revising, and
enforcing information technology policies and standards. (b) The Secretary shall develop a statewide information technology master plan. (C) (1) THE SECRETARY SHALL ESTABLISH IMPLEMENT THE FOLLOWING
TIME LINE FOR UNITS OF THE EXECUTIVE BRANCH OF STATE GOVERNMENT TO
MAKE INFORMATION AND SERVICES AVAILABLE TO THE PUBLIC OVER THE
INTERNET: (I) 50% BY CALENDAR YEAR 2002; (II) 65% BY CALENDAR YEAR 2003; AND (III) 80% BY CALENDAR YEAR 2004. (2) THIS SUBSECTION DOES NOT APPLY TO PUBLIC INSTITUTIONS OF
HIGHER EDUCATION. (3) THE SECRETARY SHALL ESTABLISH GUIDELINES TO IMPLEMENT
THE PROVISIONS OF THIS SUBSECTION. [(c)] (D) Except as provided in subsection [(d)] (E) of this section, in
accordance with guidelines established by the Secretary, each unit of the Executive
Branch of State government shall develop and submit to the Secretary: (1) information technology policies and standards; [and] (2) an information technology plan; AND (3) AN ANNUAL PROJECT PLAN OUTLINING THE STATUS OF EFFORTS TO
COMPLY WITH SUBSECTION (C) OF THIS SECTION. [(d)] (E) The governing boards of the public institutions of higher education
shall develop and submit information technology policies and standards and an
information technology plan for their respective institutions or systems to the
Secretary. [(e)] (F) In the case of the plans, policies, and standards for the public
institutions of higher education, the Secretary shall incorporate those submissions
into the statewide plan, provided the submissions are consistent with the statewide
plan. If the Secretary finds that the submissions are not consistent with the plan, the
Secretary shall return the submissions to the governing boards, which shall revise the
submissions as appropriate before resubmission to the Secretary. [(f)] (G) Before carrying out the powers and duties provided by this section,
the Secretary shall consult with the Comptroller.
