DRAFTER'S NOTE: In subsection (a)(1)(ii) of this section, the reference to "City
Council" is substituted for the former reference to "local legislative body"
for consistency within the subtitle. In subsection (a)(1)(i) of this section, the reference to "the board of
municipal and zoning appeals" is substituted for the former reference to
the "board of appeals" to conform to current practice and for consistency
throughout this subtitle. 2.10. Enforcement and remedies. (a) (1) The Mayor and City Council OF BALTIMORE may provide by
ordinance for the enforcement of this article and of any ordinance ENACTED or
regulation [made thereunder] ADOPTED UNDER THIS ARTICLE. (2) (I) A violation of this article or of [such] AN ordinance ENACTED or
regulation ADOPTED UNDER THIS ARTICLE is a [misdemeanor, and the]
MISDEMEANOR (II) THE Mayor and City Council OF BALTIMORE [may provide for] MAY: 1. REQUIRE punishment by fine or imprisonment or [both. It
is also empowered to provide] BOTH; AND 2. ENACT OR ADOPT civil penalties for [such] A violation. (b) (1) The Mayor and City Council OF BALTIMORE may provide by
ordinance that a violation of this article or of an ordinance ENACTED or regulation
[enacted] ADOPTED under this article [shall be] IS a civil zoning violation. (2) [The] A CIVIL ZONING violation shall be enforced as provided in [§
7.01(c)] § 7.02 of this article. (c) [In case any building, sign, or structure is erected, constructed,
reconstructed, altered, repaired, converted, or maintained, or any building, sign,
structure, or land is used in violation of this article or of any ordinance or other
regulation made under authority conferred hereby, the proper local authorities of
Baltimore City, in] IN addition to ANY other AVAILABLE remedies, THE PROPER
LOCAL AUTHORITIES OF BALTIMORE CITY may institute any appropriate action or
proceedings [to prevent) TO: (1) PREVENT [such] THE unlawful erection, construction,
reconstruction, alteration, repair, conversion, maintenance, or use[, to restrain,] OF A
SIGN, A BUILDING, A STRUCTURE, OR LAND IN VIOLATION OF THIS ARTICLE OR OF
ANY ORDINANCE ENACTED OR REGULATION ADOPTED UNDER THIS ARTICLE; (2) RESTRAIN, correct, or abate [such violation, to prevent] THE
VIOLATION; (3) PREVENT the occupancy of [said] THE building, structure, or [land,
or to prevent) LAND; OR
