Safety and Health Administration; requiring the Commissioner to submit a
certain notice and make certain recommendations to the General Assembly and
certain committees of the General Assembly at a certain time;
and generally
relating to the Bloodborne Pathogen Standard. BY adding to Article - Labor and Employment Section 5-1001 through 5-1004 to be under the new subtitle "Subtitle 10. Bloodborne Pathogen Standard"
Annotated Code of Maryland
(1999 Replacement Volume) SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows: Article - Labor and Employment SUBTITLE 10. BLOODBORNE PATHOGEN STANDARD. 5-1001. (A) IN THIS SECTION THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.
(B) (1) "BLOODBORNE PATHOGENS" MEANS PATHOGENIC MICROORGANISMS THAT ARE PRESENT IN HUMAN BLOOD AND CAN CAUSE DISEASE
IN HUMANS.
(2) "BLOODBORNE PATHOGENS" INCLUDES: (I) HEPATITIS B VIRUS (HBV); (II) HEPATITIS C VIRUS (HCV); AND (III) HUMAN IMMUNODEFICIENCY VIRUS (HIV). (C) "ENGINEERED SHARPS INJURY PROTECTION" MEANS A PHYSICAL
ATTRIBUTE THAT
: (1) IS BUILT INTO A NEEDLE DEVICE OR NONNEEDLE SHARP; AND (2) REDUCES EXPOSURE RISK BY; (I) CREATING A BARRIER; (II) BLUNTING; (III) ENCAPSULATION; (IV) WITHDRAWAL; (VI) RETRACTION; (VI) DESTRUCTION; OR
