5-1104. IF A PAYEE MAKES A TRANSFER OF STRUCTURED SETTLEMENT PAYMENT
RIGHTS IN VIOLATION OF THIS SUBTITLE, THE STRUCTURED SETTLEMENT OBLIGOR
OR ANNUITY ISSUER MAY NOT INCUR ANY ADDITIONAL LIABILITY.
IF A TRANSFER OF
STRUCTURE SETTLEMENT PAYMENT RIGHTS HAS BEEN AUTHORIZED UNDER THIS
SUBTITLE, NEITHER THE ANNUITY ISSUER NOR THE STRUCTURED SETTLEMENT
OBLIGOR SHALL HAVE ANY LIABILITY TO THE PAYEE OR TO ANY OTHER PARTY FOR
ANY PAYMENT MADE TO THE TRANSFEREE IN ACCORDANCE WITH THE
AUTHORIZATION.
5-1105. (A) THE PROVISIONS OF THIS SUBTITLE MAY NOT BE WAIVED. (B) NOTHING CONTAINED IN THIS SUBTITLE MAY BE CONSTRUED TO
AUTHORIZE A TRANSFER OF STRUCTURED SETTLEMENT PAYMENT RIGHTS IN
CONTRAVENTION OF APPLICABLE LAW OR TO GIVE EFFECT TO A TRANSFER OF
STRUCTURED SETTLEMENT PAYMENT RIGHTS THAT IS INVALID UNDER APPLICABLE
LAW. SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall apply to
any transfer of structured settlement payment rights under a transfer agreement
entered into on or after the effective date of this Act; provided, however, that nothing
contained in this section shall imply that any transfer under a transfer agreement
entered into prior to the effective date of this Act is ineffective. SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2000. Approved May 11, 2000.
CHAPTER 367
(House Bill 360) AN ACT concerning Health Care Workers' Safety Act - Bloodborne Pathogen Standard FOR the purpose of requiring the Maryland Occupational Safety and Health Advisory
Board to develop revisions to the Bloodborne Pathogen Standard including
certain terms and requirements; requiring the Board to submit recommended
revisions to the Commissioner of Labor and Industry and the Secretary of
Health and Mental Hygiene by a certain date; requiring the
Commissioner and
the Secretary to jointly of Labor and Industry in consultation with the Secretary
of the Department of Health and Mental Hygiene to adopt regulations
containing the recommendations by a certain date; defining the circumstances
under which the Act applies; defining certain terms that implement the
Bloodborne Pathogen Standard as established by the federal Occupational
