13-1005. (A) THERE IS A STATEWIDE PUBLIC HEALTH COMPONENT IN THE PROGRAM. (B) THE PURPOSE OF THE STATEWIDE PUBLIC HEALTH COMPONENT IS TO
MAXIMIZE THE EFFECTIVENESS OF THE ANTITOBACCO INITIATIVE
S IN THE STATE
BY AUTHORIZING THE DEPARTMENT TO TAKE STEPS TO ENSURE THAT THE
PROGRAM IS IMPLEMENTED IN A COORDINATED AND INTEGRATED MANNER
THROUGHOUT THE STATE.
(C) SUBJECT TO SUBSECTIONS (D) AND (E) OF THIS SECTION AND AS
NECESSARY TO ENSURE A COORDINATED AND INTEGRATED STATEWIDE EFFORT TO
IMPLEMENT TOBACCO USE PREVENTION AND CESSATION PROGRAMS, THE
DEPARTMENT MAY:
(1) DEVELOP AND IMPLEMENT PROGRAMS THAT ARE NOT ESTABLISHED
OR FUNDED UNDER OTHER PROVISION
S OF THIS SUBTITLE; (2) ISSUE REQUESTS FOR PROPOSALS FOR PROGRAMS THAT ARE NOT
ESTABLISHED OR FUNDED UNDER OTHER PROVISIONS OF THIS SUBTITLE; AND
(3) DISTRIBUTE GRANTS TO OR ENTER INTO CONTRACTS WITH OTHER
PERSONS WHO DEVELOP AND IMPLEMENT PROGRAMS THAT ARE NOT ESTABLISHED
OR FUNDED UNDER OTHER PROVISIONS OF THIS SUBTITLE.
(D) IF THE DEPARTMENT ISSUES A REQUEST FOR PROPOSALS, DISTRIBUTES A
GRANT, OR ENTERS INTO A CONTRACT AS AUTHORIZED UNDER SUBSECTION (C) OF
THIS SECTION, THE REQUEST FOR PROPOSAL, GRANT, OR CONTRACT SHALL
; (1) STATE WITH SPECIFICITY THE OBJECTIVES AND PERFORMANCE
CRITERIA THAT WILL BE USED TO MEASURE THE SUCCESS OF THE PROGRAM TO
WHICH THE REQUEST FOR PROPOSAL, GRANT, OR CONTRACT RELATES.
(2) STATE THAT PRIORITY WILL BE GIVEN TO ENTITIES WITH A
DEMONSTRATED RECORD OF SUCCESSFUL MARKETING AND OUTREACH TO
TARGETED MINORITY GROUPS.
(E) TO THE MAXIMUM EXTENT PRACTICABLE, THE DEPARTMENT SHALL
AWARD ONE THIRD OF THE CONTRACTS WITH PRIVATE ENTITIES TO ENTITIES OR
HIGHER EDUCATION INSTITUTIONS WITH DEMONSTRATED RECORDS OF

SUCCESSFUL MARKETING AND OUTREACH TO TARGETED MINORITY GROUPS. 13-1006. (A) THERE IS A LOCAL PUBLIC HEALTH COMPONENT IN THE PROGRAM. (B) THE PURPOSE OF THE LOCAL PUBLIC HEALTH COMPONENT IS TO
MAXIMIZE THE EFFECTIVENESS OF ANTITOBACCO INITIATIVES IN THE STATE BY
AUTHORIZING LOCAL HEALTH COALITIONS TO DEVELOP AND IMPLEMENT TOBACCO
USE PREVENTION AND CE
SSATION PROGRAMS IN COORDINATION WITH THE
DEPARTMENT.
