PARRIS N. GLENDENING, Governor Ch. 304
(4) TO THE EXTENT PRACTICABLE, ACCOUNT FOR AUTOMOBILE TRIPS
NOT TAKEN DUE TO DEMAND MANAGEMENT MEASURES, INCLUDING TELEWORKING,
TELESHOPPING, AND LAND USE PATTERNS SUPPORTING ALTERNATIVES TO
DRIVING; AND (5) INDICATE THE COST EFFECTIVENESS OF INVESTMENTS FOR
ACHIEVING RELEVANT PERFORMANCE GOALS AND BENCHMARKS, INCLUDING A
SPECIFIC ANALYSIS OF PLANNED TRANSPORTATION INVESTMENTS DETAILING: (I) ANY PROJECTED DECREASES OR INCREASES IN INDICATORS OF
TRAFFIC CONGESTION AS DEFINED BY THE DEPARTMENT; AND (II) THE COST PER PASSENGER MILE AND OTHER INDICATORS OF
COST EFFECTIVENESS AS DEFINED BY THE DEPARTMENT. SECTION 2. AND BE IT FURTHER ENACTED, That the measurable
performance indicators, benchmarks, and goals established by the Department under
this Act may not serve as the basis of any cause of action brought by any party seeking
damages or injunctive relief, or in any tort action to block a transportation project for
the alleged failure to meet the indicators, benchmarks, or goals.
SECTION 2. 3. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 2000. Approved May 11, 2000.
CHAPTER 304
(Senate Bill 777) AN ACT concerning Creation of a State Debt - Baltimore City - Star Spangled Banner Flag House and 1812 Museum FOR the purpose of authorizing the creation of a State Debt not to exceed $1,000,000
$200,000 $100,000, the proceeds to be used as a grant to the Board of Directors
of the Star Spangled Banner Flag House Association, Inc. for certain
development or improvement purposes; providing for disbursement of the loan
proceeds, subject to a requirement that the grantee provide and expend a
matching fund; providing that the grantee will grant and convey a certain
easement to the Maryland Historical Society Trust; and providing generally for
the issuance and sale of bonds evidencing the loan. SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That: (1) The Board of Public Works may borrow money and incur indebtedness on
behalf of the State of Maryland through a State loan to be known as the Baltimore
City - Star Spangled Banner Flag House and 1812 Museum Loan of 2000 in a total
