(5) In the Department of Agriculture, $2,260,000 in Cigarette Restitution
Funds appropriated to program LA12.10. Office of Marketing, Animal Industries, and
Consumer Services, for the purpose of crop conversion may not be expended for that
purpose. Authorization is hereby granted to transfer these funds to program MQ01.03.
Medical Care Provider Reimbursements, to cover deficiencies in that program. If these
funds are not transferred as authorized, they may not be expended and shall revert to
the Cigarette Restitution Fund at the end of the fiscal year.
SECTION 42. AND BE IT FURTHER ENACTED, That, in addition to
any requirements imposed under Section 1 of this Act, the amounts
appropriated from the Cigarette Restitution Fund in this budget shall be
restricted as provided in this section:
(1) In the Community and Public Health Administration of the
Department of Health and Mental Hygiene. $71,500,000 in Cigarette
Restitution Funds appropriated to program MF02.06. Prevention and Disease
Control, is restricted as follows:
(a) $17,315.486 of this amount shall be contingent on enactment of
SB 896/HR 1425 and may be used only for the Tobacco Use Prevention and
Cessation Program established under SB 896/HR 1425 as provided in this
paragraph.
(i) Funds for the Tobacco Use Prevention and Cessation
Program shall be allocated among program components as listed below, and
may not exceed the amounts indicated for each component:
Local Public Health  7,000,000 Countermarketing 5,000,000 Statewide Public Health 1,500,000 Surveillance and Evaluation 2,990,939 Administrative 824,547 (ii) Funds allocated to the Administrative Component shall
be used to fund all of the administrative costs in the department related to
developing, implementing, and managing all components of the Tobacco Use
Prevention and Cessation Program The department may not use any funds
from the Local Public Health. Countermarketing. Statewide Public Health.
and Surveillance and Evaluation Components for administrative purposes of
the department. (iii) Any entity that receives funds under the Local Public
Health, Countermarketing, Statewide Public Health, and Surveillance and
Evaluation Components may use a maximum of 7% of the funds for
administrative costs.
(iv) Of the funds allocated to the Statewide Public Health
Component of the Tobacco Use Prevention and Cessation Program, not less
than $750,000 may be used only for grants that will he used to provide
outreach and start-up technical assistance to the African American
community in the State for the purpose of organizing participation in the
