(2) PROVIDE FOR THE DISPOSITION OR RETENTION OF EXISTING LOCAL
CORRECTIONAL FACILITIES IN THE COUNTY.

(B) BUDGET.

(1) AFTER CONSIDERING THE PROBABLE INCOME FROM THE
CORRECTIONAL FARM PROPERTY, A GOVERNING BODY SHALL PREPARE AN ANNUAL
BUDGET OF PROPOSED EXPENDITURES FOR THE:

(I) CARE, OPERATION, AND MAINTENANCE OF THE PROPERTY;

AND

(II) FEEDING OF INMATES.

(2) A BUDGET PREPARED AS PROVIDED UNDER PARAGRAPH (1) OF THIS
SUBSECTION SHALL BE INCLUDED IN THE COUNTY'S ANNUAL BUDGET.

(3) ANY LEVY IMPOSED FOR THE BUDGET PREPARED AS PROVIDED
UNDER PARAGRAPH (1) OF THIS SUBSECTION SHALL BE COLLECTED AS PART OF THE
COUNTY TAX.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 25, § 133 and the second sentence of former § 128.

In subsection (a)(1) of this section, the reference to "real or personal"
property needed is substituted for the former, reference to "such property
as may be" needed for clarity and consistency with § 11-405(a)(1) of this
subtitle,

In subsection (b)(1) of this section, the phrase "[a]fter considering the
probable income from the correctional farm property" is substituted for the
former reference to "taking carefully into account in the preparation
thereof, the probable income from the property" for clarity.

Also in subsection (b)(1) of this section, the former reference to property
"committed to [the] care [of the governing body] under this subtitle" is
deleted as implicit in the reference to the "correctional farm property".

The Correctional Services Article Review Committee notes, for
consideration by the General Assembly, that this section grants to the
County Council of a Charter county authority that may otherwise be
exercised by the County Executive. The General Assembly may wish to
amend this section to authorize the "county", rather than the defined term
"governing body", to exercise the powers listed in this section.
