SUBTITLE 4. CORRECTIONAL FARMS.
11-401. "GOVERNING BODY" DEFINED.

IN THIS SUBTITLE, "GOVERNING BODY" MEANS:

(1) THE COUNTY COUNCIL OF A COUNTY WITH A CHARTER FORM OF
GOVERNMENT ESTABLISHED UNDER ARTICLE XI-A OF THE MARYLAND
CONSTITUTION; OR

(2) THE BOARD OF COUNTY COMMISSIONERS OF ANY OTHER COUNTY

REVISOR'S NOTE: This section is new language substituted for former Art. 25,
§ 134. The revision clarifies that a county with any form of government
may be authorized to establish correctional farms under this subtitle, by
the use of the common reference to the new defined term "governing body".

Defined term: "County" § 1-101

11-402. SCOPE OF SUBTITLE.

THIS SUBTITLE DOES NOT APPLY TO FREDERICK, GARRETT, HARFORD,
HOWARD, WASHINGTON, AND WORCESTER COUNTIES.

REVISOR'S NOTE: This section is new language added to codify Section 2 of
Chapter 82 of the 1957 Laws of Maryland, which provides: "THAT THE
PROVISIONS HEREIN SHALL NOT APPLY TO FREDERICK,
GARRETT, HARFORD, HOWARD, WASHINGTON AND WORCESTER
COUNTIES." The former uncodified provision was referenced as an
Editor's Note to each former section of the former subtitle.

11-103. ESTABLISHMENT.

THE GOVERNING BODY OF A COUNTY MAY ESTABLISH A CORRECTIONAL FARM.

REVISOR'S NOTE: This section is new language derived without substantive
change from the first sentence of former Art. 25, § 128.

In this section and throughout this subtitle, the reference to "correctional"
farm is substituted for the former reference to "prison" farm for
consistency with terminology throughout the article referring to a
"correctional facility" instead of a "prison".

Defined terms: "County" § 1-101
"Governing body" § 11-401

11-404. ACQUISITION OF PROPERTY; BUDGET.

(A) ACQUISITION OF PROPERTY.

A GOVERNING BODY MAY:

(1) PURCHASE OR OTHERWISE ACQUIRE REAL OR PERSONAL PROPERTY
NEEDED FOR A CORRECTIONAL FARM; AND
