(3) THE ORIGINAL PAPERS REPRESENTING THE CLAIM AND ALL
APPENDED DOCUMENTS CONSTITUTE A PERMANENT CLAIMS RECORD.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 41, § 4-701(d).

In subsection (b) of this section, the reference to a "written" statement is
added to state expressly that which was only implied in the former
reference to a "statement".

Also in subsection (b) of this section, the reference to "conditional or
limited approval" is added for consistency with subsection (a)(2) of this
section.

In subsection (c)(2)(i) of this section, the requirement that "[t]he Board ...
send a copy of the original papers representing the claim and all appended
documents to ... the Comptroller ... and ... the Secretary of Budget and
Management" is added to state expressly that which was only implied in
the last clause of the third sentence of former Art. 41, § 4-701(d), which
required that copies of these documents "be kept ... [by] the Comptroller
and ... the Secretary of Budget and Management".

In subsection (c)(3) of this section, the reference to "all appended
documents" is substituted for the former reference to "any other matters
pertaining thereto" for consistency with subsection (c)(1) and (2)(i) of this
section.

10-308. CLAIM PAYMENTS.

(A) DETERMINATION OF COMPENSATION.

IN DETERMINING WHAT COMPENSATION, IF ANY, TO ALLOW A CLAIMANT, THE
BOARD SHALL CONSIDER:

(1) THE GOOD FAITH OF THE CLAIMANT;

(2) THE POSSIBILITY THAT THE ALLEGED INJURY WAS SELF-INFLICTED
OR NOT ACCIDENTAL;

(3) THE EXTENT AND NATURE OF THE INJURY;

(4) THE DEGREE OF DISABILITY;

(5) THE PERIOD OF DISABILITY OR INCAPACITY FOR OTHER WORK; AND

(6) THE ORDINARY EARNING POWER OF THE CLAIMANT.

(B) GOVERNOR TO INCLUDE MONEY IN THE STATE BUDGET.
