Correction is substituted for the former obsolete reference to the
"Department" of Correction to reflect current nomenclature. See Ch. 401,
Acts of 1970.

In subsection (b) of this section, the reference to an Individual who is
sentenced to the "jurisdiction of the Division of Correction" is substituted
for the former reference to an individual who is "sentenced to
imprisonment" for consistency with subsection (a) of this section.

Defined terms: "Division of Correction" § 1-101
"Inmate" § 1-101

"State correctional facility" § 1-101

9-308. TRANSFER OR EXCHANGE OF CONVICTED OFFENDERS UNDER TREATY.

IF A TREATY BETWEEN THE UNITED STATES AND A FOREIGN COUNTRY
PROVIDES FOR THE TRANSFER OR EXCHANGE OF CONVICTED OFFENDERS TO THE
COUNTRY OF WHICH THEY ARE CITIZENS OR NATIONALS, THE GOVERNOR MAY
AUTHORIZE, ON BEHALF OF THE STATE AND SUBJECT TO THE TERMS OF THE
TREATY, THE COMMISSIONER OF CORRECTION TO CONSENT TO THE TRANSFER OR
EXCHANGE OF OFFENDERS AND TAKE ANY OTHER ACTION NECESSARY TO INITIATE
THE PARTICIPATION OF THE STATE IN THE TREATY.

REVISOR'S NOTE: This section formerly was Art. 27, § 690B.

The former reference to a treaty "in effect" is deleted as implicit in the
reference to "treaty".

The only other changes are in style.

Defined term: "Commissioner of Correction" § 1-101

SUBTITLE 4. STATE REIMBURSEMENT OF LOCAL CORRECTIONAL FACILITIES.
9-401. DEFINITIONS.

(A) IN GENERAL.

IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS INDICATED.

REVISOR'S NOTE: This subsection is new language derived without
substantive change from the introductory clause of former Art. 27, §
690(d)(1).

(B) ACTUAL NUMBER OF INMATE DAYS.

"ACTUAL NUMBER OF INMATE DAYS" MEANS THE NUMBER OF TOTAL INMATE
DAYS SERVED BY SENTENCED INMATES WITH SENTENCES OF MORE THAN 3 MONTHS
AND NOT MORE THAN 12 MONTHS.

REVISOR'S NOTE: This subsection is new language derived without
substantive change from former Art. 27, § 690(d)(1)(i).
