In item (14) of this section, the phrase "carry out this subtitle" is
substituted for the former reference to "carry out its functions and duties
as set forth in this section" for consistency throughout this article.

Defined terms: "Approved correctional training school" § 8-201
"Commission" § 8-201
"Correctional officer" § 8-201
"County" § 1-101
"Secretary" § 1-101

8-209. PROBATIONARY APPOINTMENT OF CORRECTIONAL OFFICERS.

(A) QUALIFICATIONS.

AN INDIVIDUAL. MAY NOT BE GIVEN OR ACCEPT A PROBATIONARY OR
PERMANENT APPOINTMENT AS CORRECTIONAL OFFICER, CORRECTIONAL
SUPERVISOR, OR CORRECTIONAL ADMINISTRATOR UNLESS THE INDIVIDUAL
SATISFACTORILY MEETS MINIMUM QUALIFICATIONS ESTABLISHED BY THE
COMMISSION.

(B) PROBATIONARY APPOINTMENT; TRAINING.

A PROBATIONARY APPOINTMENT AS A CORRECTIONAL OFFICER,
CORRECTIONAL SUPERVISOR OR CORRECTIONAL ADMINISTRATOR MAY BE MADE
FOR NO MORE THAN 1 YEAR FOR THE PURPOSE OF ENABLING THE INDIVIDUAL
SEEKING PERMANENT APPOINTMENT TO TAKE A TRAINING COURSE PRESCRIBED BY
THE COMMISSION.

(C) LEAVE OF ABSENCE.

A PROBATIONARY APPOINTEE IS ENTITLED TO A LEAVE OF ABSENCE WITH PAY
DURING THE PERIOD OF THE TRAINING PROGRAM.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 41, § 4-301(f) and (g).

In subsections (a) and (b) of this section, the word "individual" is
substituted for the former references to "person" because only individuals
can accept probationary or permanent appointment as a correctional
officer, correctional supervisor, or correctional administrator. See § 1-101
of this article for the definition of "person".

Also in subsection (a) of this section, the former phrase "as defined in this
section" is deleted as surplusage because such references are not needed
for defined terms.

Also in subsection (a) of this section, the former reference to July 1, 1976 is
deleted as obsolete.

Defined terms: "Commission" § 8-201

"Correctional administrator" § 8-201
