1999 LAWS OF MARYLAND

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 41, § 4-301(e)(1) through (6) and (9) through (14).

In the introductory language of this section, the former references to the
Commission's "authority" and "responsibilities" are deleted as surplusage
in light of the synonymous reference to the "powers" and "duties" of the
Commission.

In item (1) of this section, the former reference to "existing" training
schools is deleted as implicit in the reference to "training schools".

In item (5)(iv) of this section, the phrase "eligibility requirements" is
substituted for the former reference to "eligibility to attend" for
grammatical consistency within this item.

In item (8) of this section, the former reference to correctional training
schools "as defined in this subtitle" is deleted as surplusage because such
references are not needed for defined terms.

In item (9) of this section, the former provision that makes the
Commission's authority, to adopt regulations subject to the Secretary's
approval is deleted as unnecessary in light of the introductory language of
this section, which states that all of the Commission's powers and duties
are subject to the Secretary's approval.

Also in item (9) of this section, the requirement that the Commission
"adopt" regulations is substituted for the former requirement that the
Commission "promulgate" regulations for consistency with similar
provisions in other revised articles of the Code. See General Revisor's Note
to this article.

Also in item (9) of this section, the former reference to "rules" is deleted in
light of the reference to "regulations". See General Revisor's Note to this
article.

Also in item (9) of this section, the former requirement that the
Commission adopt regulations that are "reasonably necessary or
appropriate" is deleted in light of Title 10, Subtitle 1 of the State
Government Article, which requires that regulations be adopted according
to a procedure designed to ensure reasonableness. See, e.g., SG §
10-111.1(b).

Also in item (9) of this section, the requirement that the Commission adopt
regulations to "carry out this subtitle" is substituted for the former
requirement that the Commission adopt regulations to "accomplish the
purposes and objectives of this section" for consistency throughout this
article. See General Revisor's Note to this article.

Also in item (9) of this section, the word "individuals" is substituted for the
former reference to "persons" because only individuals apply for
certification as correctional officers. See § 1-101 of this article for the
definition of "person".
