(H) PAROLEE.

"PAROLEE" MEANS AN INDIVIDUAL WHO HAS BEEN RELEASED ON PAROLE.

REVISOR'S NOTE: This subsection is new language added to avoid repetition
of the phrase "an individual who has been released on parole".

(I) PROGRAM.

"PROGRAM" MEANS A HOME DETENTION PROGRAM ESTABLISHED UNDER §
6-108 OF THIS SUBTITLE.

REVISOR'S NOTE: This subsection formerly was Art. 41, § 4-602A(a)(6).

The reference to a program established under "§ 6-108 of this subtitle" is
substituted for the former reference to a program established under "this
subheading" to reflect the revised organization of this subtitle.

No other changes are made.

6-102. SCOPE OF SUBTITLE.

THIS SUBTITLE DOES NOT APPLY TO:

(1) AN INMATE RETAINED IN THE CUSTODY OF THE PATUXENT
INSTITUTION FOR:

(I) EXAMINATION TO DETERMINE IF THE INMATE IS AN ELIGIBLE
PERSON, AS DEFINED IN § 4-101 OF THIS ARTICLE; OR

(II) CONFINEMENT AS AN ELIGIBLE PERSON UNDER TITLE 4 OF
THIS ARTICLE; OR

(2) A JUVENILE COMMITTED TO THE JURISDICTION OF THE
DEPARTMENT OF JUVENILE JUSTICE OR AN INSTITUTION OR FACILITY UNDER ITS
JURISDICTION.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 41, § 4-611, as it related to the scope of former
Art. 41, Title 4, Subtitle 6.

In the introductory language of this section, the phrase "apply to" is
substituted for the former phrase "extend to or affect" for brevity.

In item (1)(i) of this section, the reference to an examination to determine
"if the inmate is an eligible person, as defined in § 4-101 of this article" is
added to state expressly that which was only implied in the former
reference to an examination to determine "eligibility".

In item (1)(ii) of this section, the reference to confinement as an eligible
person "under Title 4 of this article" is added to state expressly that which
was only implied in the former reference to "confinement as an eligible
person".
