5-302. DIRECTOR; DEPUTY DIRECTOR

(A) APPOINTMENT.

(1) WITH THE APPROVAL OF THE SECRETARY, THE COMMISSIONER
SHALL APPOINT THE DIRECTOR AND DEPUTY DIRECTOR OF THE PRETRIAL RELEASE
SERVICES PROGRAM.

(2) THE DIRECTOR IS THE HEAD OF THE PRETRIAL RELEASE SERVICES

PROGRAM.

(B) TENURE; SALARY.

(1) THE DIRECTOR AND DEPUTY DIRECTOR OF THE PRETRIAL RELEASE
SERVICES PROGRAM SERVE AT THE PLEASURE OF THE COMMISSIONER

(2) THE DIRECTOR AND DEPUTY DIRECTOR ARE ENTITLED TO THE
COMPENSATION PROVIDED IN THE STATE BUDGET.

REVISOR'S NOTE: This section is new language derived without substantive
change from the second and third sentences and, as it specified the head of
the Pretrial Release Services Program, the first sentence of former Art. 41,
§ 4-1406(a).

In subsection (b)(2) of this section, the reference to "compensation" is
substituted for the former reference to "salaries" for consistency
throughout this article. See General Revisor's Note to this article.

Also in subsection (b)(2) of this section, the former reference to the
"annual" State budget is deleted as implicit in the reference to the "State
budget".

THERE IS A BALTIMORE CITY DETENTION CENTER IN THE DIVISION.

(B) FUNCTION.

THE BALTIMORE CITY DETENTION CENTER IS A PRETRIAL DETENTION
FACILITY FOR INMATES COMMITTED OR TRANSFERRED TO THE CUSTODY OF THE
COMMISSIONER

(C) HOUSING AUTHORIZED.
