REVISOR'S NOTE TO SECTION: Former Art. 27, § 681(4), which defined
"[p]rograms" as "the State Use Industries programs provided and
administered by the Division" is deleted as unnecessary in light of the
unambiguous ways in which this word is used throughout this subtitle.
Former Art. 27, § 681(7) and (8), which defined "goods" and "service",
respectively, are deleted as unnecessary because the definitions did not
add anything to the meaning of these terms as commonly used.
3-502. LEGISLATIVE POLICY.
THE PURPOSE OF THIS SUBTITLE IS TO ESTABLISH A STATE USE INDUSTRIES
ORGANIZATION IN THE DIVISION THAT:
(1) IS FINANCIALLY SELF-SUPPORTING, GENERATES REVENUE FOR ITS
OPERATIONS AND CAPITAL INVESTMENTS, AND REIMBURSES THE DIVISION AT A
REASONABLE RATE FOR SERVICES EXCHANGED BETWEEN THE DIVISION AND STATE
USE INDUSTRIES;
(2) PROVIDES MEANINGFUL WORK EXPERIENCES FOR INMATES THAT
ARE INTENDED TO ALLOW INMATES TO IMPROVE WORK HABITS, ATTITUDES, AND
SKILLS FOR THE PURPOSE OF IMPROVING THE EMPLOYABILITY OF THE INMATES ON
RELEASE;
(3) SEEKS TO DEVELOP INDUSTRIES THAT PROVIDE FULL-TIME WORK
EXPERIENCE OR REHABILITATION PROGRAMS FOR ALL ELIGIBLE INMATES;
(4) OPERATES CORRECTIONAL INDUSTRIES IN AN ENVIRONMENT THAT
RESEMBLES AS CLOSELY AS POSSIBLE THE ENVIRONMENT OF PRIVATE SECTOR
BUSINESS OPERATIONS; AND
(5) MAKES THE DIVISION RESPONSIBLE FOR AND ACCOUNTABLE TO
THE SECRETARY AND THE GOVERNOR FOR THE STATE USE INDUSTRIES PROGRAM.
REVISOR'S NOTE: This section is new language derived without substantive
change from former Art, 27, § 680.
The Correctional Services Article Review Committee notes, for
consideration by the General Assembly, that the meaning of item (1) of this
section, which refers to services "exchanged between" the Division and
State Use Industries, is unclear. In current practice, State Use Industries
reimburses the Division for services that are provided by the Division to
State Use Industries (e.g., overhead expenses). The Division does not
reimburse State Use Industries for services provided by State Use
Industries to the Division (e.g., training and supervising inmates). The
General Assembly may wish to amend item (1) of this section to reflect
current practice, i.e., to provide that State Use Industries shall reimburse
the Division for services that are provided by the Division to State Use
Industries. Alternatively, the General Assembly may wish to amend item
(1) of this section to define "reasonable rate" to include consideration of
