3-219. PROPERTY ACQUISITION AND DISPOSAL.

(A) ACQUISITION.

THE DIVISION MAY ACQUIRE PROPERTY BY CONTRACT, PURCHASE, OR OTHER
MEANS AS REQUIRED FOR THE DIVISION'S USE AND FOR THE USE OF ITS UNITS.

(B) DISPOSAL.

THE DIVISION MAY SELL, DISPOSE OF, OR OTHERWISE CONVEY ANY PROPERTY
AS APPROPRIATE TO THE NEEDS OF THE DIVISION AND ITS UNITS.

(C) TITLE TO PREVIOUS PROPERTY.

THE DIVISION HOLDS TITLE TO AND HAS POSSESSION OF ALL PROPERTY
PREVIOUSLY ACQUIRED BY THE FORMER DEPARTMENT OF CORRECTION OR ANY
UNIT OF THAT DEPARTMENT.

(D) TRUSTEE OF THE STATE.

THE DIVISION HOLDS TITLE TO AND HAS POSSESSION OF PROPERTY AS A
TRUSTEE OF THE STATE.

(E) AUTHORITY OF BOARD OF PUBLIC WORKS.

THE DIVISION'S CUSTODY, USE, ACQUISITION, AND CONVEYANCE OF PROPERTY
ARE SUBJECT GENERALLY TO THE POWERS AND FUNCTIONS OF THE BOARD OF
PUBLIC WORKS.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 668.

In subsections (a), (b), (c), (d), and (e) of this section, the references to the
"Division" are substituted for the former, obsolete references to the
"Department". See General Revisor's Note to this subtitle.

In subsection (c) of this section, the former reference to "real, personal, and
mixed" property is deleted as implicit in the reference to "all property".

Also in subsection (c) of this section, the former reference to "existing"
property is deleted as implicit in the reference to "property".

The former reference to property "which may be acquired by the
Department and any institution or agency thereunder" is deleted as
obsolete. See General Revisor's Note to this subtitle.
