(d) Instead of or in addition to suspending or revoking a certificate of
authority, the Commissioner may:

(1) impose on the holder a penalty of not less than $100 but not more
than $125,000 for each violation of this article; and

(2) require the holder to make restitution to any person who has suffered
financial injury because of the violation of this article.

(e) The Commissioner shall adopt regulations to:

(1) establish standards for the imposition of a penalty under subsection
(d) of this section; and

(2) carry out the provisions of subsection (b)(11) of this section.

(b) (2) If a private passenger motor vehicle insurance policy issued, sold, or
delivered in the State includes:

(i) collision coverage under this section, the motor vehicles insured
under that coverage shall include any passenger car that is rented by an insured for
a period of 30 days or less under a rental agreement as otherwise defined in § 14-2101
of the Commercial Law Article; or

(ii) comprehensive coverage, the motor vehicles insured under that
coverage shall include any replacement vehicle as defined under § 18-102(a)(2)(i) of
the Transportation Article.
