Ch. 687                                    1997 LAWS OF MARYLAND

generally relating to overtime compensation for employees under the prevailing
wage law.

BY repealing and reenacting, with amendments,
Article - State Finance and Procurement
Section 17-214, 17-219, 17-222, and 17-226
Annotated Code of Maryland
(1995 Replacement Volume and 1996 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - State Finance and Procurement

17-214.

(A) EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, EACH contractor
and subcontractor under a public work contract shall pay not less than the prevailing

wage rate of:

(1) straight time to an employee who works:

(I) [8] 10 hours or less in a single calendar day except a Sunday or
legal holiday; and OR

(II) 40 HOURS OR LESS DURING 1 WORKWEEK; AND

(2) overtime to an employee for each hour the employee works;

(i) in excess of [8] 10 hours in any single calendar day; [and]

(II) IN EXCESS OF 40 HOURS DURING 1 WORKWEEK; AND OR

[(ii)] (III) on a Sunday or legal holiday. STRAIGHT TIME TO AN
EMPLOYEE FOR EACH HOUR THAT THE EMPLOYEE WORKS.

(B) A CONTRACTOR AND SUBCONTRACTOR SHALL PAY AN EMPLOYEE THE
PREVAILING WAGE RATE OF OVERTIME FOR EACH HOUR THAT THE EMPLOYEE WORKS:

(1) IN EXCESS OF 10 HOURS IN ANY SINGLE CALENDAR DAY;

(2) IN EXCESS OF 40 HOURS PER EACH WORKWEEK; OR

(3) ON SUNDAY OR A LEGAL HOLIDAY.

17-219.

(a) Each contractor under a public work contract subject to this subtitle shall:

(1) post a clearly legible statement of each prevailing wage rate to be paid
under the public work contract; and
