(a) (1) On or before March 1 of each year, a nonprofit health service plan shall
file with the Commissioner a true statement of its financial condition, transactions, and
affairs for the immediately preceding calendar year.
(2) The statement shall:
(i) Contain the information required by the Commissioner; and
(ii) Be certified to by an independent certified public accountant.
(3) [The fee provided for by § 41 of this article shall be submitted at the
same time as the statement.
(4)] Any nonprofit health service plan failing to file the statement required
wider this subsection by March 10 shall forfeit;
(i) $100 for each day up to and including March 10; and
(ii) $150 for each day after March 10 until the statement is filed with
the Commissioner.
[(5)] (4) The Commissioner may extend the time for filing for good cause.
[(6)](5) The penalties provided under paragraph [(4)(i)] (3)(I) of this
subsection do not apply if the nonprofit health service plan has obtained an extension
from the Commissioner for filing the required statement.
(6) IN ORDER TO MAINTAIN A CERTIFICATE OF AUTHORITY, A
NONPROFIT HEALTH SERVICE PLAN SHALL COMPLY WITH THE PROVISIONS OF §§ 41
THROUGH 41G OF THIS ARTICLE.

[(d) On filing an application for a certificate of authority, the dental plan
organization shall pay a fee of $200 to the Commissioner.]

(e) A certificate of authority shall expire on [June 30] JULY 31 following the date
of issuance or previous renewal. If the dental plan organization remains in compliance
with this subtitle and [has paid a renewal fee of $100] WITH §§ 41 THROUGH 4lG OF
THIS ARTICLE, its certificate shall be renewed.

(f) The Commissioner [may];
(1) [Require] MAY REQUIRE actuarial studies and audits to determine
each group's financial solvency as often as the Commissioner considers desirable;
(2) [Assess each self-insurance group an annual sum of not more than $500
to be used for the actuarial studies and audits] SHALL REQUIRE THAT, AS A
CONDITION OF THE COMMISSIONER'S APPROVAL OF ITS CONTINUED OPERATION IN
