SECTION 5. 12. 19. 18. AND BE IT FURTHER ENACTED, That, subject to the
provisions of Sections 9 and 11 18 17 of this Act, this Act shall take effect July 1, 1997.
Section 4 of this Act shall remain effective for a period of 2 years and, at the end of June
30. 1999. with no further action required by the General Assembly. Section 4 of this Act
shall be abrogated and of no further force and effect.

AN ACT concerning
Job-Related Drug Testing
FOR the purpose of clarifying that job related drug testing is not limited to testing of
urine or blood samples; authorizing certain hair specimen the use of certain hair
specimen testing only for pre-employment drug testing; requiring employers that use
hair specimens for pre-employment drug testing to adhere to certain standards;
prohibiting employers that use hair specimens for pre-employment drug testing from
using the specimens to determine certain information; clarifying that independent
testing applies to all types of job-related drug testing; clarifying that certain
laboratory standards be in accordance with regulations for similar laboratory
certification; providing for the effective date of this Act; defining a term; and
generally relating to job-related drug testing.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Health - General
17-214.
(a) In this section the following words have the meanings indicated.
(1) "Alcohol or controlled dangerous substance testing" means a procedure
used to determine whether or not a specimen contains a controlled dangerous substance
or alcohol.
(2) "Certification" means the approval granted by the Department for a
laboratory to engage in job-related alcohol or controlled dangerous substance testing.
