(3) becomes a retiree; or

(4) dies.

Article - Education

15-108.

(A) IN THIS SECTION, "EMPLOYEE LEAVE TIME" MEANS THE FOLLOWING
TYPES OF LEAVE:

(1) HOLIDAY LEAVE:

(2) ANNUAL LEAVE;

(3) PERSONAL LEAVE:

(4) SICK LEAVE; AND

(5) ADMINISTRATIVE AND OTHER RELATED LEAVE.

(B) AS PROVIDED IN THIS SECTION, EACH PUBLIC INSTITUTION OF HIGHER
EDUCATION IS AUTHORIZED TO ESTABLISH EMPLOYEE LEAVE TIME FOR ITS
SKILLED EMPLOYEES, PROFESSIONAL EMPLOYEES. AND EMPLOYEES IN A STATUS
THAT IS EQUIVALENT TO SKILLED EMPLOYEES OR PROFESSIONAL EMPLOYEES IN
THE STATE PERSONNEL MANAGEMENT SYSTEM, DESCRIBED IN TITLE 6 OF THE
STATE PERSONNEL AND PENSIONS ARTICLE.

(C) THE NUMBER OF DAYS ESTABLISHED BY A PUBLIC INSTITUTION OF
HIGHER EDUCATION AS EMPLOYEE LEAVE TIME SHALL TOTAL AT LEAST THE
NUMBER OF DAYS PROVIDED TO EMPLOYEES IN THE STATE PERSONNEL
MANAGEMENT SYSTEM UNDER TITLE 9. SUBTITLES 2, 3, 4. AND 5 OF THE STATE
PERSONNEL AND PENSIONS ARTICLE

SECTION 2. AND BE IT FURTHER ENACTED, That a State employee member
of the State Employees' Retirement System, State Police Retirement System, or
Correctional Officers' Retirement System who returned to State service between October
1, 1996 and July 1, 1997 and who as a result was separated from State service for a period
less than 3 years shall be reinstated in the State Employees' Retirement System, State
Police Retirement System, or Correctional Officers' Retirement System, as provided
under the provisions of this Act.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
July 1, 1997.
