(As enacted by Section 1 of this Act)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section(s) 4-106 of Article 41 - Governor - Executive and
Administrative Departments of the Annotated Code of Maryland be transferred to be
Section(s) 30A of Article 88B - Department of State Police of the Annotated Code of
Maryland.

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:

Article 38A - Fires and Investigations

1.

(a) There is hereby created a State Fire Prevention Commission, which shall
consist of 9 persons, qualified by experience and training to deal with the matters which
are the responsibilities of the Commission, appointed by the Secretary of [Public Safety
and Correctional Services] THE STATE POLICE, with the approval of the Governor. The
Commission shall be part of the Department of [Public Safety and Correctional Services]
STATE POLICE. The term of office of the members first taking office shall expire as
designated by the Governor at the time of appointment, one at the end of one year, one
at the end of two years, one at the end of three years, two at the end of four years, and
two at the end of five years. Each succeeding term shall be for five years, and any member
is subject to removal by the Secretary of [Public Safety and Correctional Services] THE
STATE POLICE, with the approval of the Governor at any time for neglect of his duties or
