(House Bill 636)

AN ACT concerning

Prince George's County Board of Education - Passage of Motions - Voting Requirements

PG 428-97

FOR the purpose of specifying the number of members of the Prince George's County
Board of Education that constitute an affirmative vote for passage of motions by the
Board under specified circumstances; and generally relating to the voting
requirements for passage of motions by the Prince George's County Board of
Education.

BY repealing and reenacting, with amendments,

Section 3-1004
Annotated Code of Maryland
(1997 Replacement Volume)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Education

3-1004.

(a) The County Board shall hold an annual meeting on the first Monday in
December to elect a chairman and vice-chairman from among its members.

(b) All actions of the County Board shall be taken at a public meeting and a
record of the meeting and all actions shall be made public.

(c) This section does not prohibit the County Board from meeting and
deliberating in executive session provided that all action of the Board, together with the
individual vote of each member, is contained in a public record.

(D) (1) EXCEPT AS OTHERWISE PROVIDED IN PARAGRAPH (2) OF THIS
SUBSECTION, THE AFFIRMATIVE VOTE OF THE MEMBERS OF THE COUNTY BOARD
FOR THE PASSAGE OF A MOTION BY THE COUNTY BOARD SHALL BE:

(I) SIX MEMBERS WHEN THE STUDENT MEMBER IS VOTING; OR

(II) FIVE MEMBERS WHEN THE STUDENT MEMBER IS NOT VOTING.

(2) WHEN THERE IS ONE VACANCY OR MORE THAN ONE VACANCY ON
THE COUNTY BOARD, THE AFFIRMATIVE VOTE OF THE MEMBERS OF THE COUNTY
BOARD FOR THE PASSAGE OF A MOTION BY THE BOARD SHALL BE FIVE MEMBERS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1997.
