Special Fund Appropriation, provided that no
funds may be expended for the purpose of
constructing a refrigerated warehouse facility
at the Port of Baltimore until the budget
committees have received a report from the
Maryland Department of Transportation:

(1)     identifying potential clients likely to use the
facility, including those who have signed
written agreements or have stated interest;

(2)        including the refrigerated warehouse
facility as part of a strategic business plan and
facilities master plan for the Port of Baltimore;

(3)     justifying construction of the facility based
on pertinent market and industry information

. available; and

(4)     the budget committees have reviewed and
commented upon the report or 45 days have

elapsed from the date the report is received by
