1997 LAWS OF MARYLAND

2. AN INDIVIDUAL MEDICARE SUPPLEMENT POLICY THAT
PROVIDES ONLY THE BENEFITS THAT ARE REQUIRED UNDER § 15-906(A) OF THIS
SUBTITLE.

(2) IF MEMBERSHIP IN A GROUP IS TERMINATED, THE CARRIER:

(I) SHALL OFFER THE CERTIFICATE HOLDER THE CONVERSION
OPTIONS UNDER PARAGRAPH (1) OF THIS SUBSECTION; OR

(II) AT THE OPTION OF THE GROUP POLICYHOLDER, SHALL OFFER
THE CERTIFICATE HOLDER A CONTINUATION OF COVERAGE UNDER THE GROUP
MEDICARE SUPPLEMENT POLICY.

(3) (I) IF A GROUP MEDICARE SUPPLEMENT POLICY IS REPLACED BY
ANOTHER GROUP MEDICARE SUPPLEMENT POLICY PURCHASED BY THE SAME
POLICYHOLDER, THE SUCCEEDING CARRIER SHALL OFFER COVERAGE TO EACH
INDIVIDUAL WHO WAS COVERED UNDER THE OLD GROUP MEDICARE SUPPLEMENT
POLICY ON ITS DATE OF TERMINATION,

(II) UNDER THE NEW GROUP MEDICARE SUPPLEMENT POLICY,
COVERAGE MAY NOT BE EXCLUDED FOR A PREEXISTING CONDITION THAT WOULD
HAVE BEEN COVERED UNDER THE GROUP MEDICARE SUPPLEMENT POLICY BEING
REPLACED.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, § 468CA.

In subsection (a) of this section, the reference to "§ 15-906(a)(3) of this
subtitle", which revises former Art. 48A, § 468C(b)(2)(iii), is substituted for
the former erroneous reference to former Art. 48A, "§ 468C(b)(1)(iii)".

Also in subsection (a) of this section, the reference to the original "Medicare
supplement policy" is substituted for the former reference to the original
"policy" for clarity.

In subsection (b)(1)(i) of this section, the former phrase "available for sale in
this State" is deleted as unnecessary.

In subsection (e) of this section, the reference to the "succeeding carrier" is
substituted for the former reference to the "replacing insurer" for consistency
with terminology used in this subtitle.

In subsection (g)(3)(i) of this section, the reference to an "individual" is
substituted for the former reference to a "person" because only an individual
can be offered coverage under a group policy.
