15-714. PSYCHOLOGISTS.

(A) SCOPE OF SECTION.

THIS SECTION APPLIES TO EACH INDIVIDUAL OR GROUP HEALTH INSURANCE
POLICY, CONTRACT, OR CERTIFICATE THAT:

(1) (I) IS ISSUED OR DELIVERED IN THE STATE;

(II) IS ISSUED TO A GROUP THAT IS INCORPORATED OR HAS A
MAIN OFFICE IN THE STATE; OR

(III) COVERS INDIVIDUALS WHO RESIDE OR WORK IN THE STATE;

AND

(2) IS ISSUED, RENEWED, AMENDED, OR REISSUED ON OR AFTER JULY

1, 1972.

(B) REIMBURSEMENT FOR SERVICES.

NOTWITHSTANDING ANY OTHER PROVISION OF A POLICY, CONTRACT, OR
CERTIFICATE SUBJECT TO THIS SECTION, IF THE POLICY, CONTRACT, OR
CERTIFICATE PROVIDES FOR REIMBURSEMENT FOR A SERVICE THAT IS WITHIN THE
LAWFUL SCOPE OF PRACTICE OF A LICENSED PSYCHOLOGIST, THE INSURED OR ANY
OTHER PERSON COVERED BY THE POLICY, CONTRACT, OR CERTIFICATE IS
ENTITLED TO REIMBURSEMENT FOR THE SERVICE REGARDLESS OF WHETHER THE
SERVICE IS PERFORMED BY A PHYSICIAN OR LICENSED PSYCHOLOGIST.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, § 490A.

In the introductory language of subsection (a) of this section, the former
references to "sickness", "accident", and "disability" insurance are deleted as
unnecessary in light of the comprehensive definition of "health insurance".

In subsection (a)(1)(i) of this section, the reference to a policy, contract, or
certificate that is "issued or" delivered in the State is added to clarify the
applicability of this section.

In subsection (a)(1)(iii) of this section, the reference to "individuals" who
reside or work in the State is substituted for the former reference to "persons"
since only an individual can reside or work in the State.

In subsection (a)(2) of this section, the former references to a policy, contract,
or certificate that is "modified" or "altered" are deleted as included in the
reference to a policy, contract, or certificate that is "amended".
