PARRIS N. GLENDENING, Governor

Ch. 35

Defined terms: "Health insurance" § 1-101
"Insurer" § 1-101
"Policy" § 1-101

15-712. PHYSICIAN ASSISTANTS.

NOTWITHSTANDING § 15-701(A) OF THIS SUBTITLE, UNLESS A POLICY,
CONTRACT, OR CERTIFICATE DESCRIBED IN § 15-701(A) OF THIS SUBTITLE
EXPRESSLY PROVIDES FOR REIMBURSEMENT FOR A SERVICE THAT IS WITHIN THE
LAWFUL SCOPE OF PRACTICE OF A PHYSICIAN ASSISTANT CERTIFIED UNDER THE
HEALTH OCCUPATIONS ARTICLE, THE PROVISIONS OF THE HEALTH OCCUPATIONS
ARTICLE THAT GOVERN THE CERTIFICATION AND REGULATION OF PHYSICIAN
ASSISTANTS MAY NOT BE CONSTRUED TO ENTITLE THE INSURED OR ANY OTHER
PERSON COVERED BY THE POLICY, CONTRACT, OR CERTIFICATE TO
REIMBURSEMENT FOR THE SERVICE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, §§ 354Z(d), 470U(d), and 477AA(d).

The reference to a policy, contract, or certificate "described in § 15-701(a) of
this subtitle" is added to clarify the applicability of this section.

Defined terms: "Person" § 1-101
"Policy" § 1-101

15-713. PODIATRISTS.

NOTWITHSTANDING ANY OTHER PROVISION OF AN INDIVIDUAL, GROUP, OR
BLANKET HEALTH INSURANCE POLICY, IF THE POLICY PROVIDES FOR
REIMBURSEMENT FOR A SERVICE THAT IS WITHIN THE LAWFUL SCOPE OF
PRACTICE OF A LICENSED PODIATRIST, THE INSURED OR ANY OTHER PERSON
COVERED BY THE POLICY IS ENTITLED TO REIMBURSEMENT FOR THE SERVICE
REGARDLESS OF WHETHER THE SERVICE IS PERFORMED BY A PHYSICIAN OR
LICENSED PODIATRIST.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, § 490.

The reference to an "individual" health insurance policy is added to clarify the
applicability of this section.

The reference to a "physician" is substituted for the former reference to a
"doctor of medicine" for consistency within this subtitle.

The former references to a policy of "accident insurance", "sickness
insurance", "accident and sickness insurance", "disability insurance", "group
accident insurance", and "group health and accident insurance" are deleted as
unnecessary in light of the comprehensive reference to an "individual, group,
or blanket health insurance" policy.

The former reference to a "podiatrical" service is deleted as unnecessary in
light of the reference to a service "that is within the lawful scope of practice of
a licensed podiatrist".
