provided for in the supporting budget documents. The expenditure or transfer of these
funds for other purposes requires the prior approval of the Secretary of Budget and Fiscal
Planning. Notwithstanding any other provision of law, the Secretary of Budget and Fiscal
Planning may transfer amounts appropriated in SWS J64 between State departments and
agencies by approved budget amendment in fiscal years 1996 and 1997.
SECTION 12. AND BE IT FURTHER ENACTED, That, pursuant to Section
6-102 of the State Personnel and Pensions Article, the salary schedule for the executive
pay plan during fiscal year 1997 shall be as set forth below. Adjustments to the salary
schedule may be made during the fiscal year in accordance with the provisions of Sections
6-108 and 6-109 of the State Personnel and Pensions Article, provided, however, that
these increases are delayed until October 1, 1996 and that the total cost of such increases
may not exceed $477,121 $357,841 for Fiscal Year 1997 and the Governor shall develop an
appropriate method for allocating increases among participants in the executive pay plan
within the existing pay plan structure. Notwithstanding the inclusion of salaries for
positions which are determined by agencies with independent salary setting authority in
the salary schedule set forth below, such salaries may be adjusted during the fiscal year in
accordance with such salary setting authority. It is the intent of the General Assembly
that the maximum amount of a salary increase for an individual promoted to or within the
executive pay plan should be 3% unless otherwise approved by the Board of Public
Works.
