extent that the Administration is unable to
fulfill its responsibility to find appropriate
community placement, it should develop a
small regional capacity to meet the needs of
the remaining individuals within their
current catchment.
It is the intent of the General Assembly that,
upon closure of the Great Oaks facility, any
individuals remaining without appropriate
community placement not be relocated to
another institution against their will. To the
extent that such individuals remain, the
Developmental inabilities Administration is
to provide for appropriate residential
support in the region.

All appropriations provided for Community
Services (32.13.01.02) are to be used only
for the purposes herein appropriated and
may only be transferred for the purpose of
enhancing or matching federal funds for
services for individuals with developmental
disabilities. All funds remaining at the close
of June 30, 1997, shall revert to the general
fund.
It is the intent of the General Assembly that,
during annual budget formulation, the
Department of Health and Mental Hygiene
utilize an objective standard to annually
adjust rates paid for community services and
supports provided to individuals with
developmental disabilities. Further, the
department should develop regulations
governing the use of this standard. This
would be comparable to the current practice in
the Adult Medical Day Care program of using
Ch. 13
