planning stage, the County is authorized to
transfer funds from one project to another.
(D) Subject to paragraph (A), funding for
the eligible on-site improvement projects
for which JKCI or JKCS has agreed to
manage as set forth in Schedule A shall be
provided through a MDOT grant to Prince
George's County, which shall be used only
to reimburse JKCI or JKCS based on
submission of invoices of up to $31.2 million
provided that MDOT has received a written
agreement that JKCI or JKCS shall provide
at least $25 million towards the cost of the
non-transportation trust fund eligible
on-site improvements and that JKCI or
JKCS agrees to be responsible for any cost
overruns. Further provided that JKCI or
JKCS shall be responsible for the
maintenance of the on-site non-roadway
projects identified on Schedule A regardless
of the entity responsible for constructing
those infrastructure improvements. Because
the projects identified on Schedule A for
which JKCI or JKCS has construction
management responsibility are only in the
project planning stage, the JKCI or JKCS is
authorized to transfer funds from one
project to another.
(E) It is the intent of the General Assembly
that any monies spent by MDOT for the
infrastructure construction occurring as a
result of the construction of the Redskins
Stadium must be transportation related as
specified in this budget bill language or the
language contained in the $225 million
appropriation in Supplemental Budget No.
1.
(F) Notwithstanding provisions "(A)"
through "(E)" as enumerated above this
language shall only take effect upon the
submission of a signed memorandum of
understanding (MOU) by all parties,
including the State of Maryland, JKCI or
JKCS, Prince George's County, and the
Maryland-National Capital Park and
