REVISOR'S NOTE TO SECTION;

Former Art. 48B, § 1(2), which defined "Division" to mean the Insurance Division,
is deleted as obsolete. The former Insurance Division is now the Insurance
Administration. See § 2-101 of this article.

Former Art. 48B, § 1(3), which defined "Commissioner" to mean the Commissioner
of Insurance or the Commissioner's duly authorized representatives, is deleted as
unnecessary in light of the defined term "Commissioner" in § 1-101 of this article.

Former Art. 48B, § 1(5), which defined "applicant" to mean a person applying for a
certificate of authority or for renewal of a certificate of authority under this article, is
deleted as unnecessary. In the context of the provisions in which the term "applicant" is
used, it is clear what applicant is referred to in each provision. Thus, a separate definition
of the term is unnecessary.

Former Art. 48B, § 1(11), which defined "person" to mean an individual, firm,
association, partnership, corporation, or other legal entity, is deleted as unnecessary in
light of the defined term "person" in § 1-101 of this article.

26-102. SCOPE OF TITLE.

(A)     IN GENERAL.

(1)     THE OFFERING OF MOTOR CLUB SERVICE IS REGULATED UNDER
THIS TITLE BUT IS NOT ENGAGING IN INSURANCE BUSINESS.

(2)     THIS TITLE DOES NOT OTHERWISE EXEMPT A LICENSEE OR ITS
REPRESENTATIVES FROM THE REQUIREMENTS OF THE LAWS RELATING TO
INSURANCE OR INSURANCE SERVICES.

(B)     EFFECT ON OTHER SERVICES OR PRODUCTS.

THIS TITLE DOES NOT LIMIT OR PROHIBIT A MOTOR CLUB FROM SELLING,
OFFERING FOR SALE, OR FURNISHING TO OR PROCURING FOR MEMBERS SERVICES
OR PRODUCTS NOT DEFINED IN THIS TITLE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48B, §§ 12 and 13.

In subsection (a)(2) of this section, the former reference to ''regulations" is
deleted as included in the comprehensive reference to "laws".
