(J) PERSON.

"PERSON" INCLUDES A GOVERNMENTAL UNIT.

REVISOR'S NOTE: This subsection is new language derived without substantive
change from former Art. 48A, § 243L(g).

The former references to "natural persons", "firms", "copartnerships",
"associations", and "corporations" are deleted as unnecessary in light of the
definition of "person" in § 1-101 of this article.

Defined term: "Person" § 1-101

(K) PRODUCER.

"PRODUCER" MEANS A QUALIFIED BROKER OR QUALIFIED AGENT, INCLUDING
AN INDEPENDENT AGENT, THAT HAS BEEN ASSIGNED A PRODUCER
AUTHORIZATION CODE BY THE FUND.

REVISOR'S NOTE: This subsection is new language derived without substantive
change from former Art. 48A, § 243L(1).

The reference to a producer authorization code that is "assigned" is
substituted for the former reference to one that is "applied for and received"
to conform to the requirement that a producer obtain a number or
"authorization code" from the Fund. As to the procedures for application and
assignment of producer authorization codes, see COMAR 14.07.02.01.

The former phrase "in this State" is deleted as surplusage in light of the use of
defined terms "qualified broker" and "qualified agent".

"Qualified broker" § 1-101

(L). UNINSURED MOTOR VEHICLE.

"UNINSURED MOTOR VEHICLE" MEANS A MOTOR VEHICLE FOR WHICH:

(1)     THE SECURITY REQUIRED UNDER § 17-103 OF THE
TRANSPORTATION ARTICLE IS NOT IN. FORCE; OR

(2)     THE SECURITY REQUIRED UNDER § 17-103 OF THE
TRANSPORTATION ARTICLE IS IN FORCE BUT A RECEIVER OR CONSERVATOR HAS
BEEN APPOINTED BY A COURT FOR THE INSURER THAT ISSUED THE SECURITY.
